Terms<\/strong>
\nDeliveries, services and offers by Easymotors Zollikofen GmbH are made exclusively on the basis of these terms and conditions. By ordering goods or services, the terms are deemed to be accepted. Any general purchasing conditions of the buyer are hereby rejected. Deviations from these terms and conditions must be confirmed in writing.<\/p>\n

Offer and contract<\/strong>
\nOffers by Easymotors Zollikofen GmbH in price lists and advertisements are non-binding. The product offering is directed exclusively at customers resident in Switzerland. Deliveries are made exclusively to addresses in Switzerland. The information in our sales documents (drawings, illustrations, dimensions, weights and other specifications) is to be understood as approximate values only and does not constitute a guarantee of characteristics. We are released from our delivery obligation if a buyer exceeds their credit limit.<\/p>\n

Prices<\/strong>
\nThe prices stated in our order confirmation are decisive. For stock items, these are fixed at the time of the order. Unless otherwise agreed, prices include statutory value added tax, plus transport costs.<\/p>\n

Delivery and performance times<\/strong>
\nDates and delivery periods are non-binding unless otherwise agreed in writing. The indication of specific delivery periods and delivery dates by Easymotors Zollikofen GmbH is subject to the correct and timely supply of Easymotors Bern by third parties. By arrangement, 1-2 weeks.<\/p>\n

Default of acceptance<\/strong>
\nIf, after expiry of a grace period set for them, the buyer declares that they do not wish to accept the delivery items, Easymotors Zollikofen GmbH may refuse to perform the contract and demand damages for non-performance. Easymotors Zollikofen GmbH is entitled to demand from the buyer as damages, at its option, either a lump sum of 25 % of the agreed purchase price or compensation for the damage incurred.<\/p>\n

Delivery \/ collection<\/strong>
\nVisible quantity discrepancies must be reported to Easymotors Zollikofen GmbH in writing immediately upon receipt of the goods, hidden quantity discrepancies within 24 hours of receipt of the goods. Complaints regarding damage, delay or loss must be reported immediately upon arrival of the shipment.<\/p>\n

Transfer of risk<\/strong>
\nThe risk passes to the buyer as soon as the shipment has been handed over to the person carrying out the transport. If dispatch is delayed or becomes impossible through no fault of ours, the risk passes to the buyer upon notification of readiness for dispatch. Any assumption of the transport costs by Easymotors Zollikofen GmbH agreed in individual cases has no effect on the transfer of risk.<\/p>\n

Warranty<\/strong>
\nThe warranty in accordance with the following provisions is 2 years, unless expressly agreed otherwise in writing. The warranty period begins on the delivery date. If our operating or maintenance instructions are not followed, modifications are made, parts are replaced or consumables are used that do not comply with the original specifications, any warranty lapses insofar as the defect is attributable to this. This also applies insofar as the defect is attributable to improper use, storage and handling of the devices, or to third-party interference or the opening of devices. Insignificant deviations from warranted characteristics of the goods do not give rise to any warranty rights. Liability for normal wear and tear, as well as for consumables\/accessories, is excluded. Warranty claims against Easymotors Zollikofen GmbH are available only to the direct buyer and are not assignable.<\/p>\n

Right of return<\/strong>
\nFor returns, we require that the defective part or device be sent or delivered to Easymotors Zollikofen GmbH for repair together with a complete and detailed description of the fault\/defect and a copy of the invoice with which the device was delivered. Any return of products by the customer requires the prior consent of Easymotors Bern and is at the customer's expense and risk. Special orders that we procure at the customer's request are excluded from return. The replacement of parts, assemblies or entire devices does not trigger any new warranty periods. The warranty is limited exclusively to the repair or replacement of the damaged delivery items.<\/p>\n

You have the option of returning your vehicle within seven days. The following costs apply to a return:
\n\u2013 Return fee:<\/strong> 200 CHF
\n\u2013 Kilometre charge:<\/strong> 2 CHF per kilometre driven

\nPlease note that it makes a difference whether the vehicle was financed or paid for in cash. For financed vehicles, an additional cancellation fee of 8 % of the purchase price is charged.

\nThe total costs may vary depending on whether the vehicle still needs to be collected or has already been delivered. In this case, the travel costs for the return journey will also be charged.<\/p>\n

Retention of title<\/strong>
\nThe delivered goods remain the property of Easymotors Zollikofen GmbH until full payment has been made.<\/p>\n

Payment<\/strong>
\nDepending on the agreement, invoices are payable by cash on delivery, in cash or within 30 days net, unless otherwise agreed. Cash payment is only possible in the case of collection from the branch. When paying by credit card, the amount is debited at the time of the order. In the case of prepayment, delivery only takes place after receipt of payment. Delivery is generally made carriage forward, i.e. at the buyer's expense, by parcel post, freight forwarder or own vehicle, unless expressly agreed otherwise. A payment is only deemed to have been made when we can dispose of the amount. If the buyer is in default, we are entitled to charge interest at a rate of 5 % from the relevant point in time. Costs in the event of late payment: in the event of late payment, default interest of 5% is charged from the 31st day. For the duration of the default, Easymotors Zollikofen GmbH is also entitled at any time to withdraw from the contract, to demand the return of the delivered goods and to claim damages for the lapse of the contract. All claims become due immediately if the customer defaults on payment, culpably fails to comply with other essential obligations under the contract, or if we become aware of circumstances that are likely to reduce the customer's creditworthiness, in particular suspension of payments or the initiation of composition or bankruptcy proceedings. In these cases, we are entitled to withhold outstanding deliveries or to carry them out only against advance payment or securities.<\/p>\n

Limited liability<\/strong>
\nClaims for damages arising from impossibility of performance, breach of contract, fault at the conclusion of the contract and tort are excluded, both against us and against our vicarious agents, unless there is intentional or grossly negligent conduct. Any liability for consequential damage arising from the use of the products is rejected.<\/p>\n

Copyright<\/strong>
\nFor digital content, you acquire a simple, non-transferable right of use entitling you to private or professional use as a single user. In accordance with the respective product descriptions, you may make copies of the digital content for private or other personal use, store them on reading devices and use them on these devices as intended. Books and digital content are protected by copyright and are intended exclusively for purchase for personal use. Any further use, in particular the passing on, editing, copying or reproduction, distribution, publication or making publicly available of the digital content, in whole or in part, whether in digital form, by remote data transmission or in analogue form, is not permitted and may be a punishable offence.<\/p>\n

Data protection policy<\/strong>
\nEasymotors Zollikofen GmbH is entitled to process the data received about the buyer in connection with the business relationship, whether originating from the buyer themselves or from third parties, within the meaning of the Federal Act on Data Protection (FADP). Personal customer data is treated confidentially and is only passed on to third parties in the context of credit checks.<\/p>\n

Place of jurisdiction<\/strong>
\nThe Regional Court of Bern-Mittelland is the exclusive place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship. The legal relationship is governed by Swiss law. Easymotors Zollikofen GmbH, December 2022.<\/p>\n

Purchase on invoice with partial payment option (Powerpay)<\/strong>
\nAs an external payment service provider, Powerpay offers the payment method \"purchase in instalments\". With instalment payment, you can easily settle your online purchase by debit\/credit card. Upon conclusion of the purchase contract, Powerpay takes over the resulting instalment claim and handles the corresponding payment arrangements.
